The Service

Garage Growth is a software-as-a-service (SaaS) platform designed to provide learning, analytics, and tools to assist automotive repair shops. Our Service processes shop data into reports, recommends training based on those metrics through proprietary learning modules, and provides other software tools to help repair shops achieve their goals.

User Accounts and Eligibility

• Account Requirement: You must register for an account to access the Service. You agree to provide accurate, current, and complete information during the registration process.
• Eligibility: To use the Service, you must be at least 18 years of age or the age of legal majority in your jurisdiction. By using the Service, you represent and warrant that you meet this requirement.
• User Roles: The Service may allow for different user roles, such as "Admin," "Advisor," and "Technician," which may have different levels of access and permissions. The account administrator is responsible for managing these roles and for the actions of all users associated with their account.
• Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately at legal@garage-growth.com of any unauthorized use of your account.

User-Generated Content (UGC)

Our Service allows you to input, post, and store data, including customer information, invoice data, and other business metrics ("User-Generated Content" or "UGC").

• Ownership: You (or your business entity) retain all ownership rights to your UGC.
• License to Us: To provide the Service, you grant Garage Growth a worldwide, non-exclusive, royalty-free license to host, use, process, analyze, display, and create derivative works from your UGC. This license is for the sole purpose of operating, improving, and providing the features of the Service to you, such as generating reports and training recommendations.

Payments, Subscriptions, and Refunds

Garage Growth offers a mix of free and paid services, including subscriptions, a la carte purchases, professional services, and training services.

• Payment Processors: We use third-party payment processors, including Stripe, Helcim, and GoCardless, to bill you. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processors in addition to these Terms.
• Subscriptions: We offer paid subscription plans ("Level 2," "Level 3") on a monthly or annual basis. Subscriptions automatically renew unless canceled. You may cancel your subscription at any time. Upon cancellation, you will retain access to the paid features until the end of your current, paid billing cycle, after which your account will revert to a free plan.
• A La Carte Purchases: The Service may offer standalone courses or content for a one-time fee.
• Professional Services: We may offer project-based or recurring professional services such as managed onboarding, data collection, and CRM services.
• Training & Coaching Services: We may offer training and coaching services, delivered either virtually or in-person.

Refund Policy

• Subscriptions: All paid subscriptions come with a 30-day money-back guarantee from the initial purchase date.
• A La Carte Courses: Courses purchased individually can be refunded within 30 days of purchase, provided that you have consumed less than 20% of the course content (measured by total minutes available).
• Professional Services: For one-time project-based services, a refund may be requested within 30 days of purchase, less the value of any work already performed or hours already expended. For recurring Professional Services, the 30-day guarantee applies only to the first payment; subsequent recurring payments are non-refundable.
• Training & Coaching: For any multi-session Training & Coaching package, a refund is only available prior to the second session. You may request a full refund for the package up to 48 hours before the first scheduled session. Once the first session is complete, or if cancellation is not requested at least 48 hours prior to the start of the first session, the entire package fee becomes non-refundable. While subsequent sessions are ineligible for refunds, they may be rescheduled with at least 24 hours' notice, subject to availability.
• Live Classes: Can be refunded in full up to 14 days before the class start date. A 50% refund is available if requested between 1 and 14 days before the class start date. No refunds are available on or after the day the class begins.
• Requesting a Refund: To request a refund, please email devon@garage-growth.com.
• Abuse of Refund Policy: Garage Growth, Inc. reserves the right to refuse a refund to any user who we determine, in our sole discretion, is abusing our refund policy. Abuse may include, but is not limited to, a pattern of repeatedly purchasing and refunding services, or requesting refunds after a significant portion of a product or service has been consumed or delivered.

User Conduct and Prohibited Activities

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Upload or transmit any virus, malware, or other malicious code.
• Attempt to reverse-engineer, decompile, or otherwise compromise the Service.
• Engage in any activity that is fraudulent, false, or misleading.
• Copy, reproduce, distribute, sell, transfer, or otherwise exploit for any commercial purpose any course content, including videos, text, or resources, provided through the Service.

Intellectual Property Rights

Excluding your UGC, the Service and all of its original content, features, and functionality are and will remain the exclusive property of Garage Growth, Inc. and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms.

Termination

• Termination by You: You may terminate your account at any time by sending a deletion request to support@garage-growth.com.
• Termination by Us: We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms or non-payment of fees.

Disclaimers and Warranties

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. Garage Growth, Inc. makes no warranties, express or implied, regarding the Service's reliability, availability, or accuracy.

Disclaimer of Professional Advice and Results: Any financial claims, projections, or results displayed within reports or trainings are based on calculations or past client results and are for illustrative purposes only. They do not constitute a guarantee of future performance, nor do they constitute financial, legal, or professional advice. You agree that you are solely responsible for any business decisions or actions you take based on information from the Service.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Garage Growth, Inc., its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. In no event shall the aggregate liability of Garage Growth, Inc. for all claims relating to the Service exceed one hundred Canadian dollars ($100.00 CAD).

Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
• Mandatory Arbitration: You and Garage Growth, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration, rather than in court.
• Class Action Waiver: You and Garage Growth, Inc. agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Garage Growth, Inc. regarding our Service.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.
